Article 1: Designation
In these general terms and conditions, the terms "we" and "our" refer to Amyna3 Sàrl and the term "you" refers to the customer.
Article 2 : Acceptance of the conditions
The customer acknowledges having read, at the time the order is placed, the conditions set out on this screen and expressly declares that he accepts them without reservation. The present conditions of use govern the contractual relationship between Amyna3 Sàrl and its customer, both parties accepting them without reserve.
Article 3 : Photography
The images and/or photographs illustrating the products offered on our website are not contractual. Amyna3 Sàrl cannot be held liable for any errors that may have been introduced. In particular, it is possible that, depending on the colour settings made, the colours of the products may differ from the actual products. Technical information and links are given for information purposes only. The technical specifications and/or content of the products delivered may also differ from the data provided by the manufacturers or displayed on the Internet.
Article 4: Prices
All our prices are in Swiss Francs. The prices indicated do not include transport costs and recycling taxes (SWICO/TAR). The amount invoiced to the customer is the price indicated on the order confirmation on which the transport costs, recycling taxes and possible discounts are displayed. The prices indicated on the order confirmation are authoritative, even in the event of a variation between the date of order and the date of delivery of the goods. In the event of a price error on a product, Amyna3 Sàrl reserves the right to modify the price by offering the customer the choice to cancel the order if the new price does not suit him/her.
The Swiss VAT of 7.7% is included in our prices when they are displayed in "Swiss Franc" mode. For shipments abroad, our deliveries are based on prices displayed in "Swiss Franc" mode with a rate of the Euro according to the rate on the day of the order. In case of delivery abroad we do not charge VAT, but in case of customs control you will have to pay the VAT of your country (country where the package is sent) on receipt of the package and possible customs charges.
Article 5 : Order
A firm order is placed when the customer presses the "Confirm Order" button on the confirmation page. By placing an order, you are making us an offer to buy the products you have selected. We reserve the right to accept or decline this offer at our discretion. Amyna3 Sàrl confirms the acceptance of the order and its progress to the customer at the e-mail address provided by the customer when registering on the site. This confirmation is effective when the customer receives an e-mail from Amyna3 Sàrl indicating that the order has been placed in "In process" mode. This e-mail thus forms a contract of sale between you and Amyna3 Sàrl.
Amyna3 Sàrl reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. In the event of an error in the wording of the recipient's details, Amyna3 Sàrl cannot be held responsible for the impossibility of delivering the product(s) ordered.
Article 6 : Shipping costs
A fixed delivery charge is applied. The amount of the shipping costs (packaging, transport and handling costs) is fixed according to the total amount of your order.
Article 7: Delivery times
For products in stock, Amyna3 Sàrl ensures delivery within 2 to 5 working days. If the material is not in stock at the time of the order, the delivery time is determined by the availability of the product(s) at our factory. In the event of stock shortage, a delivery time of between 5 and 10 days is required. Amyna3 Sàrl indicates for each product the availability and/or the estimated delivery time and/or the delivery time provided by the distributor(s)/manufacturer(s). However, this information is indicative and is not guaranteed. The customer can at any time request by e-mail an estimate of the delivery time of his order.
Please note that for deliveries outside Switzerland, the delivery time may be longer (5 to 12 days) even for products in stock due to customs formalities and transport.
Article 8: Methods of payment
Secure payments on our website will be made by the customer according to the methods of his choice.
Article 9: Reservation of ownership
Amyna3 Sàrl remains the owner of all goods delivered until full payment of the related invoice.
Article 10: Damage, errors and problems during delivery
Any transport damage (e.g. a damaged package) must be reported immediately to the carrier when the latter carries out the delivery, failing which the customer shall assume responsibility for any damage to the goods.
Any goods delivered by mistake or in excess must be returned immediately, or within 7 days at the latest. In the event of non-return, the goods will be invoiced.
Our packages are sent as standard parcels (without signature). Amyna3 Sàrl does not under any circumstances assume the loss or theft of a package sent without a signature. It is the customer's responsibility to ensure that his mailbox is secure or to inform his post office not to leave a parcel in his absence.
Article 11 : Retraction
As a general rule, goods cannot be taken back. The return of delivered goods is possible in exceptional cases, as long as they are not damaged or opened and are still in their original packaging. The right of withdrawal does not apply to orders for the supply of products ordered specifically for the customer: software licences, specific products, etc.
Article 12: Returns
For any return related to a delivery error, a defective product, etc. a return request is mandatory. All return requests must be made by e-mail. Returns are accepted only with original carton. If the customer no longer possesses the original packaging of the returned goods, the customer is responsible for any costs charged by the manufacturers.
Article 13 : Our responsibility
These "General Conditions" determine all our obligations and responsibilities. We are not bound by any other warranty, condition or other provision, except those expressly mentioned in this contract.
Any warranties, obligations or other provisions concerning the products or services which may be implied or incorporated into this contract by law, case law or otherwise (including but not limited to any implied conditions as to quality, fitness for any purpose and any duty of care) are hereby expressly excluded. In particular, Amyna3 Sàrl is not responsible for ensuring that the products are suitable for your intended use.
We shall not be liable under this contract for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind whatsoever resulting from or caused by any tortious act (including negligence), breach of contract or otherwise. Our total liability for any breach of contract (including negligence) or otherwise shall in no event exceed the amount you owe us for the products or services in question.
We shall not be liable to you for any loss or damage suffered by you arising from our delay in performing any of our obligations or our failure to perform all or part of our obligations under the contract where such delay or failure is due to circumstances beyond our control. In the event of delay, we shall perform our obligations as soon as possible.
Amyna3 Sàrl cannot be held liable for damages of any kind, whether material, immaterial or corporal, that may result from the malfunction or misuse of the products marketed. Amyna3 Sàrl's liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products.
Article 14 : Data protection
Amyna3 Sàrl undertakes to comply with the provisions of the Federal Data Protection Act. All personal data transmitted by the customer is treated confidentially and will not be passed on to third parties under any circumstances. The customer has the possibility to modify his personal data at any time or to request their deletion.
Article 15: Disputes
This contract is subject to Swiss law. In the event of a dispute, Amyna3 Sàrl reserves the right to choose the court of law to be seized.
Article 16: Other cases
For all other cases not governed by these terms and conditions of sale, the Code of Obligations applies. All our prices are inclusive of VAT (7.7%), exclusive of recycling tax and delivery costs. Prices are subject to change | Non-contractual photos |
